Mike Huckabee: Trump could nominate Moses for Supreme Court and Democrats would fight it

Former Republican Arkansas Gov. Mike Huckabee said Friday that President Trump could nominate Moses for the next Supreme Court justice and Democrats would still try to block it.

“If he put Moses up for the possibility of being Supreme Court justice — the ultimate lawgiver, the Ten Commandments — [Democrats] would still be against it,” Huckabee told Fox News Friday morning.

The father of White House press secretary Sarah Sanders also added that one of the rights of a president is to have the ability to nominate Supreme Court justices when a spot becomes available.

“Let me quote a famous politician, Barack Obama, who said elections have consequences,” Huckabee continued. “They certainly do, we elect a president, he picks Supreme Court justices, it’s the way it works. … I think Democrats are going to be unhappy with whoever Donald Trump puts forward.”

Justice Anthony Kennedy, who has been on the Supreme Court for 30 years, announced his retirement this week, which will go into effect July 31. Democrats are pushing for a delay in allowing Trump to nominate his second Supreme Court pick of his presidency.

Soon after taking office, Trump nominated Neil Gorsuch to take the late Antonin Scalia’s seat on the bench after he died at the end of former President Barack Obama’s second term.

Obama also had two Supreme Court justice picks during his two terms, nominating Sonia Sotomayor and Elena Kagan.
