A federal agency filed a lawsuit Wednesday against a Chesapeake Bay bar that allegedly fired a woman with breast cancer after she refused to wear a “tankini” top.
The EEOC alleges the Red Eye?s Dock Bar, in Grasonville, violated the Americans with Disabilities Act when it discriminated against Margaret Finley, who had undergone treatment for breast cancer.
Finley asked to be excused from the bar?s dress code policy that required that she wear a “scanty” top know as a “tankini,” according to the suit.
Her request to be excused from the “tankini” requirement resulted in her termination, the federal agency alleges.
A tankini is a two-piece swimsuit that resembles a tank top.
The agency seeks back wages and damages for Finley and changes in employment policies at Red Eye?s Dock Bar.
“We bring this lawsuit to provide appropriate protection for millions of working women who are battling or who have battled breast cancer,” EEOC Regional Attorney Jacqueline McNair said in a statement.
The bar did not immediately respond to a request for comment.
