Sebastian Gorka sues to stop Jan. 6 committee’s request for phone records

Sebastian Gorka, an adviser to former President Donald Trump and a political commentator, has sued the Jan. 6 Select Committee to block its subpoena of his phone records.

The House committee asked for access to Gorka’s phone records but did not request he answer questions himself, according to the lawsuit Gorka’s attorneys filed Tuesday with the U.S. District Court for the District of Columbia seeking “relief from his political adversaries’ abuse of Congressional power to intimidate and stifle his political speech.” The committee’s interest in Gorka was unknown until his counterlawsuit came to light, Politco reported.

“Dr. Gorka was not a member or leader of any organization that sponsored any events on January 6, and was not present at the Capitol on that day,” the lawsuit said. “Although invited to speak at an event at the Supreme Court that day, his speech was canceled, and therefore, he only observed the speeches at the Ellipse as one spectator among many and left.”

Lawmakers subpoenaed Verizon for Gorka’s phone records between Nov. 1, 2020, and Jan. 31, 2021. The lawsuit says Gorka was not approached about the request, with the committee only notifying the phone company initially.

“The Select Committee’s aimless rifling through the communications records of an adverse political journalist whom it knows had no role in the events it claims to be investigating epitomizes an investigation run amok,” the lawsuit said.

The committee is in the process of investigating communication between senior White House officials in the lead-up to last year’s riot on the Capitol. Several, including former chief of staff Mark Meadows and former national security adviser Michael Flynn, have responded with lawsuits, while others, such as Rep. Scott Perry, have simply refused to comply with the committee’s requests.

Representatives for the Jan. 6 committee did not respond to the Washington Examiner’s request for comment.
