The U.S. Naval Academy superintendent will not move forward with a court-martial against a midshipman accused of rape.
Vice Adm. Jeffrey Fowler said in a statement that the academy will not seek judicial action against Midshipman Mark Calvancio of New Jersey.
Calvancio was accused of raping a fellow midshipman in her room in October 2007. But Naval Criminal Investigative Services found no physical evidence of rape or sex, and the alleged victim?s roommate who was in the room at the time said she did not believe a rape occurred.
Investigators suggested Fowler not pursue a court martial of the rape charge, but recommended action be taken on minor charges. Fowler will not pursue a court-martial on any of the charges, which included conduct unbecoming an officer.
Calvanico could still face administrative punishment from the academy, and those actions are not open to the public, academy officials said.
