LOS ANGELES (AP) — A Los Angeles gang member has been convicted of killing a man and a 22-month-old boy who were struck by the same stray bullet during an attack on gang rivals.
City News Service says jurors took only 2 ½ hours to convict Davion McClelland of murder Thursday. He could face life in prison.
Prosecutors say the 21-year-old and an accomplice rode bicycles into a neighboring gang’s turf in May of 2011 and one of them opened fire at two men.
All the shots missed but a bullet went across the street, through a vacant lot, through a fence and into a backyard, where it struck Josefat Canchola and the toddler nephew he was holding, Joshua Montes.
His lawyer claimed McClelland wasn’t there and says he plans to appeal.
