Supreme Court Justice Samuel Alito defended a recent Supreme Court ruling on a Texas abortion ban.
At a Notre Dame Law School event in South Bend, Indiana, Alito told law students the high court declining to block the new state law had nothing to do with overturning the landmark 1973 Roe v. Wade ruling that legalized abortion nationwide.
“Put aside the false and inflammatory claim that we nullified Roe v. Wade,” Alito said. “We did no such thing. And we said that expressly in our order.”

The Supreme Court declined on procedural grounds a request by abortion providers to block the Texas law this month that outlaws abortions at the stage of gestation when cardiac activity can be detected, about six weeks. Alito and the rest of the majority in the 5-4 ruling majority did express the challengers brought up important “constitutional” issues with the law.

The new Supreme Court term begins next week. Included in the new term’s docket is a Mississippi case that challenges the state’s ban on abortion after 15 weeks of pregnancy.
