The Supreme Court on Tuesday granted President Trump’s administration time to argue in Masterpiece Cakeshop Ltd. v. Colorado Civil Rights Commission, a case involving a baker who refused to make a cake for a gay wedding. It is one of the major cases coming before the high court next month.
At issue in Masterpiece is the constitutionality of Colorado’s public accommodations law forcing cake baker Jack Phillips to create speech that defies his religious beliefs by making a cake for a gay wedding.
The Justice Department has sided with Phillips amid reported internal disputes among the top lawyers in the Justice Department’s civil rights office and U.S. solicitor general’s office about which side to take.
It will argue in front of the justices in addition to the lawyers for Phillips and the Colorado Civil Rights Commission.
The cake case comes to the Supreme Court on Dec. 5, after the justices return to the high court after the Thanksgiving holiday.
