The lawyer for porn star Stormy Daniels is demanding that the Trump Organization and two banks involved in the $130,000 payment to Daniels preserve all records related to his client.
“We request that you immediately preserve all evidence, documents and tangible things and electronically storied information (‘ESI’) potentially relevant to the claim and transaction referenced above,” lawyer Michael Avenatti wrote in a letter, published by MSNBC, to the banks and Trump Organization on Thursday.
Avenatti said in the letter he intends to subpoena Trump Organization for records related to Trump lawyer Michael Cohen’s payment to Daniels to keep her quiet about the alleged affair.
Avenatti told NBC News that “this is but one of many tools we will use.”
“When we are done, the truth will be laid bare for the American people,” he said.
Trump has denied having an affair with Daniels.
Daniels is currently in a legal battle with Trump’s personal lawyer Michael Cohen after she sued Trump earlier this month, arguing their nondisclosure agreement is invalid because he never signed it. The suit was filed in Los Angeles Superior Court and alleges Cohen used “intimidation and coercive tactics” to keep Daniels from talking about the alleged affair.
Cohen has since accused Daniels of violating the nondisclosure agreement 20 times and asked for $20 million in damages.
