Attorney Sidney Powell, who is being sued by Dominion Voting Systems for spreading allegedly defamatory claims about the 2020 election, insisted on Saturday former President Donald Trump could “simply be reinstated” as president and fill the rest of President Joe Biden’s term.
Powell’s remarks were made at a right-wing conference in Dallas on Saturday called the “For God & Country Patriot Roundup,” which also featured retired Lt. Gen. Michael Flynn, Trump’s former national security adviser who has echoed the former president’s claims of widespread voter fraud in the November election, as a guest speaker.
“There are cases where elections have been overturned, but there’s never been one at the presidential level, which everybody will jump to point out, that doesn’t mean that it can’t be done,” Powell said, earning loud applause from an audience. “It should be that he can simply be reinstated, that a new inauguration date is set.”

At the height of Trump’s election fraud claims, Powell was the face of the Trump campaign’s efforts to challenge the results of the 2020 presidential election. After an interview with Newsmax TV in which she threatened to “blow up” Georgia with post-election lawsuits, Trump’s former personal attorney Rudy Giuliani released a joint statement with legal adviser Jenna Ellis saying Powell is “not a member of the Trump Legal Team.”
In response to Powell’s claim, Ellis took to Twitter to correct the assertion about the former president, saying, “No, President Trump is not going to be ‘reinstated.'”
“The election was lawless, [and] six states allowed their delegates to vote by false certifications, but the [electoral college] process happened,” Ellis wrote Sunday evening, adding a description of the line of presidential succession in the United States. “The Constitution has only one process for removal of a sitting president: impeachment and conviction.”
Powell has moved to dismiss Dominion’s $1.3 billion lawsuit against her, arguing her various claims about Dominion were statements of opinion, despite the election vendor’s most recent claims accusing her of lying about the company in order to “financially enrich herself.”
Dominion has denied the allegations of fraud and has also filed lawsuits against Giuliani, Fox News, and MyPillow founder Mike Lindell.
The 20th Amendment of the U.S. Constitution states the “terms of the President and the Vice President shall end at noon on the 20th day of January, … and the terms of their successors shall then begin” after the previous administration leaves.
The 25th Amendment provides for the possibility of a U.S. president becoming unable to serve, elevating the vice president to the position of president if such an event were to occur.
