House Democrats ripped for attacking Supreme Court and GOP justices

Democrats are using their last days in control of the House to step up attacks on the newly conservative Supreme Court, prompting an unusual and intense pushback — right to their face.

This morning, in a politically charged House Judiciary Committee hearing expected to include allegations of politicking by GOP judges, a conservative legal expert plans to undercut a key witness being featured by liberal court critic and Chairman Rep. Jerrold Nadler.

Mark Paoletta, a co-author of a newly published book about Associate Justice Clarence Thomas, is planning to question the testimony of Rev. Robert L. Schenck, a former anti-abortion activist turned liberal “whistleblower.”

He has been involved in suggestions that Justice Samuel Alito Jr. leaked his decision on the famous Hobby Lobby contraception case, charges a court ethics panel recently rejected. He also told the New York Times that conservative donors have tried to woo justices to push their point of view on the court.

“Today, the committee has convened a hearing to listen to allegations from a man, Mr. Rob Schenck, who built his career on deception and deceit,” Paoletta plans to say, according to his testimony provided in advance to Secrets.

“As first reported in a Nov. 19 New York Times story, Mr. Schenck claims that Justice Alito or his wife leaked the results and author of the Hobby Lobby decision to two of his allies three weeks before the decision was announced in 2014. There is no credible basis for this story, but it is consistent with a man who has an obsession with self-promotion and deception. A little background on this specific allegation is necessary,” Paoletta plans to tell the panel.

In addition to targeting Schenck, Paoletta plans to take on charges that there is an unusual relationship between conservative justices and legal and political influencers.

“The Democrats and their allies on the Left have driven a narrative that it is unethical or troubling for justices to have dinners or interactions with individuals who believe passionately in an issue or who are wealthy donors to organizations. But contrary to the Democrats and their media allies’ current representations, these types of interactions are consistent with the judicial ethics code, have been going on since the inception of the court, and the Democrats and their media allies have been perfectly fine when liberal justices do this,” his testimony says.

He described in his testimony the cozy relationship Justice Ruth Bader Ginsburg had with the National Organization for Women.

“I am not aware of a single congressional Democrat raising concerns about her impartiality when she appeared before that advocacy group or helped raise funds for them. But Democrats and their media allies will weaponize allegations of impartiality against conservative Justices to undermine their integrity and the decisions they issue,” said his testimony.

Instead of putting a wall around the court, Paoletta said that Congress should be encouraging justices to reach out more often.

“The justices should not be sealed off from the outside world — that is neither good for the institution nor the law,” he plans to say.
