The Committee on Foreign Investment in the United States, a critical regulatory entity within the Treasury, should ban TikTok from the U.S., argued FCC Commissioner Brendan Carr in an interview with Axios. Carr, a longtime critic of TikTok because of its connections to China, has regularly slammed TikTok but is now calling for an outright ban. The recommendation arrives as the video streaming platform negotiates with the CFIUS over national security concerns.
“I don’t believe there is a path forward for anything other than a ban,” Carr argued. The commissioner cited, as justification, the possibility of sensitive U.S. data streaming back to China, despite the company claiming that it was storing all U.S. data on servers hosted by Oracle and overseen by federal officials. While TikTok said these data were safe from unauthorized Chinese access, Carr is unconvinced.

There isn’t “a world in which you could come up with sufficient protection on the data that you could have sufficient confidence that it’s not finding its way back into the hands of the [Chinese Communist Party],” Carr said.
While Carr has attempted to ask that the markets restrict TikTok, the FCC does not maintain any power over the legality of TikTok in the U.S. Carr sent letters to Google and Apple asking that they remove TikTok from their app stores over data privacy concerns.

“Commissioner Carr has no role in the confidential discussions with the U.S. government related to TikTok and appears to be expressing views independent of his role as an FCC commissioner,” a TikTok spokesperson said in a statement.
TikTok is currently in the midst of discussions with the Biden administration regarding a deal to resolve concerns about Chinese access to U.S. data. While early reports indicated that the two entities had reached a preliminary deal, neither party has revealed any additional details about an agreement. Other reports have arisen alleging that TikTok’s parent company, ByteDance, had employees intend to use the app to track the locations of U.S. citizens.
