Rust armorer sues ammunition supplier over ‘dangerous condition’ on set

The armorer for Rust filed a lawsuit against the film’s ammunition supplier, alleging the company’s ammunition handling led to the on-set fatal shooting.

Rust armorer Hannah Gutierrez Reed filed the suit seeking compensatory damages, punitive damages, attorney’s fees, and more on Wednesday in New Mexico’s Second Judicial District Court, arguing that Seth Kenney and his company PDQ Arm & Prop had mixed live and dummy rounds on set, according to Fox News.

“Hannah and the entire Rust movie crew relied on the Defendants’ misrepresentation that they provided only dummy ammunition. In so doing, Defendants created a dangerous condition on the movie set, unbeknownst to Hannah Gutierrez Reed, which caused a foreseeable risk of injury to numerous people,” the lawsuit read.

Last year, law enforcement searched PDQ Arm & Prop, where they retrieved .45-caliber ammunition, an ammunition can, photographs, and “Rust documents,” a report added.

Gutierrez Reed denied responsibility for placing live rounds into the gun, claiming that “she never witnessed anyone shoot live rounds with these guns and nor would she permit that.” Her lawyers had previously claimed that a saboteur had placed live rounds into Baldwin’s gun.

Kenney previously told investigators that the live rounds might have come from “handmade reloaded rounds” a friend had given him. Reloaded refers to the creation of new rounds with cases that were previously fired.

Gutierrez Reed’s lawsuit is not the first filed concerning the shooting. Serge Svetnoy, the chief of lighting for Rust, filed a lawsuit on Nov. 10, 2021, accusing Alec Baldwin, Gutierrez Reed, first assistant director David Halls, and others of negligence.

In October 2021, Baldwin was on the set of Rust when he fired a gun believed to contain dummy rounds. But the weapon contained live rounds, and cinematographer Halyna Hutchins was killed, while director Joel Souza was wounded in the accidental shooting.

Representatives for Kenney and Gutierrez Reed did not respond to requests for comment from the Washington Examiner.
