Biden slammed the red states for suing the federal government over the legitimacy of the decade-old DACA program, which provides a reprieve from deportation to certain illegal immigrants who came to the United States as children with documents to work in the country.

“I am disappointed in today’s Fifth Circuit decision holding that DACA is unlawful,” Biden said in a statement late Wednesday. “Today’s decision is the result of continued efforts by Republican state officials to strip DACA recipients of the protections and work authorization that many have now held for over a decade.”
“My Administration is committed to defending Dreamers against attacks from Republican officials in Texas and other States,” Biden continued. “This challenge to DACA is just another example of the extreme agenda being pushed by MAGA-Republican officials.”
The ruling by the 5th Circuit Court of Appeals was a victory for Texas and eight other states that filed lawsuits in 2018.
DACA was created in 2012 by then-DHS Secretary Janet Napolitano through a memorandum after Congress failed to pass immigration reform legislation that would have protected and provided a pathway to citizenship for the same category of people.
The U.S. District Court for the Southern District of Texas in 2021 declared DACA invalid, prompting the Biden administration to reintroduce the program through a lengthier process that is meant to fend off future legal objections late last year. Since then, nearly 800,000 applications for DACA have been approved.
The federal judge’s decision in July 2021 concluded that the way the Obama administration created DACA in 2012 went against how Congress allows immigration levels to be set.
The 5th Circuit ruled Wednesday on the Biden administration’s appeal of the federal decision. The appeals court’s decision sends the matter back to Judge Andrew Hanen of the U.S. District Court for the Southern District of Texas, who will decide the legality of the changes made to DACA under Biden. Those changes were slated to go into effect at the end of October.

“While the 5th Circuit ruling temporarily keeps protections in place for current DACA recipients, it indicates that DACA’s days are numbered,” said Laurence Benenson, vice president of policy and advocacy at the National Immigration Forum, in a statement. “The ruling further solidifies the reality that Congress must provide certainty in the form of a permanent legislative solution that would allow Dreamers to stay and work in the country long-term.”
Congressional Hispanic Caucus Chairman Dr. Raul Ruiz (D-CA) called on 10 Senate Republicans to join Democrats and pass a DACA bill that had already passed in the House.
