A New Jersey couple filed a lawsuit against Dunkin’ Donuts on April 4 after one of them sustained “permanent injury” after his hot coffee spilled.
Evan Arlington and Stephanie Arlington-Macias sued Dunkin’ in the Superior Court of Passaic County, alleging that Evan was the victim of his Aug. 25, 2021, order.

The order consisted of two cups of coffee and one iced coffee, according to a report.

“Defendants were negligent in the preparation, sale and service of the coffee to plaintiff in that it was too hot,” the lawsuit reads.
“As a result thereof, plaintiff Evan Arlington has been severely injured, has suffered and in the future will suffer great pain and mental anguish, was forced to and in the future will be forced to expend money for medical and hospital care, has suffered and in the future will suffer a loss of income and has otherwise suffered permanent injury as a result of a defected product sold by Dunkin Donuts, XYZ Companies and John Does,” it continues.
Arlington was not the only victim, according to the suit.
Arlington-Macias “suffered a loss of her husband’s aid, comfort, conjugal fellowship and consortium,” the suit asserts.
The married couple is seeking judgment for damages along with interest and the costs of the legal action.

For “optimal extraction,” hot coffee is to be brewed between 195-205 degrees Fahrenheit, according to National Coffee Association USA. It is unknown what temperature the Dunkin’ coffee was.
