BUFFALO, N.Y. (AP) — Jury selection has begun for the only unsettled lawsuit against the airlines involved in a 2009 plane crash into a house near Buffalo.
The Buffalo News reports that no jurors were chosen Tuesday in the first day of selection in the wrongful death case filed by the family of Douglas Wielinski.
Wielinski was the only person killed on the ground when Continental Connection Flight 3407 stalled and crashed into his house as it was approaching Buffalo.
All 49 people on board the flight from Newark, New Jersey, were killed. The passengers’ families have settled their lawsuit for undisclosed amounts.
The Wielinskis’ claim names Continental Airlines, regional carrier and flight operator Colgan Air, and Colgan’s parent, Pinnacle Airlines.
The two sides differ on whether Doug Wielinski died instantly.
