The attorney representing Alec Baldwin is adamant that the FBI’s report on the fatal shooting on the set of Rust has been “misconstrued” and reiterated the claim that Baldwin never pulled the trigger.
Luke Nikas, Baldwin’s lawyer, is disputing the FBI’s claim that the trigger had to have been pulled when the gun that killed 42-year-old cinematographer Halyna Hutchins was fired on Oct. 21 on the set of Rust, according to a report.
The FBI forensic report making the claim was released Friday.

An accidental discharge of the .45 Colt caliber F.lli Pietta single-action revolver would not be possible without the trigger being pulled, according to the FBI.
Nikas said the FBI’s report is being taken out of context.
“The FBI report is being misconstrued,” he told the Daily Mail. “The gun fired in testing only one time — without having to pull the trigger — when the hammer was pulled back and the gun broke in two different places.”
“The FBI was unable to fire the gun in any prior test, even when pulling the trigger, because it was in such poor condition.”
Reports completed by New Mexican authorities paint a far better picture of what really happened, he said.

The most important report is the one completed by the medical examiner, who deemed the incident a tragic accident, according to Nikas.
