Judge orders Giuliani to appear before Fulton County grand jury

A New York judge ordered former Trump lawyer Rudy Giuliani to deliver testimony to a Fulton County grand jury on Aug. 9.

Guiliani, who was subpoenaed earlier this month, failed to attend a New York court hearing on the matter last week or adequately explain why he was not a “necessary and material witness” for investigators, according to Judge Thomas Farber of the New York Supreme Court.

“It is hereby ordered that Rudolph William Louis Giuliani appear and testify before the Special Purpose Grand Jury in the Superior Court of the State of Georgia for the County of Fulton, on August 9, 2022, and on any such other dates as the court there may order,” the judge wrote.

Farber requested Giuliani attend a show-of-cause hearing on July 13 to explain his bid to quash the Fulton County subpoena, but the former Trump lawyer was a no-show. Giuliani had been subpoenaed for testimony alongside six other Trump allies, including Sen. Lindsey Graham (R-SC). As a New York resident, he sought to challenge the subpoena in his home state.

The onetime personal lawyer for former President Donald Trump had sought to quash the subpoena against him that demanded he appear for testimony before the special grand jury for the Fulton County inquiry into whether crimes were committed during the 2020 election in Georgia. The inquiry has scrutinized the machinations of Trump and his allies following the election.

Since the inception of Fulton County District Attorney Fani Willis’s election inquiry last year, Willis has reportedly expressed particular interest in controversial comments Giuliani made about the election to the Georgia Senate in December 2020 after the election. Giuliani told a Georgia state Senate panel that a video proved election fraud transpired in Georgia’s State Farm Arena, but Republican Secretary of State Brad Raffensperger’s office “debunked” those claims, according to a subpoena against Giuliani.

“The Witness possesses unique knowledge concerning the acquisition of the State Farm video and the manner of its presentation to the Georgia State Senate as well as knowledge of the origin of numerous other claims of election fraud alleged in legal filings and to the public by the Witness, former President Trump, the Trump Campaign, and other known and unknown individuals,” the subpoena against Giuliani said.

In addition to examining Giuliani, the Fulton County inquiry is also examining a call Trump had with Raffensperger, two calls Graham had with Raffensperger, and the abrupt resignation of a U.S. attorney.

The inquiry appears to be heating up. Recent court documents showed almost a dozen alternate Trump electors were informed last month by Fulton County investigators that they are now targets of the inquiry. Additionally, Graham dropped his bid to quash a subpoena Tuesday after initially battling it in court.
