The newly elected attorney general of Virginia announced Thursday evening that he filed a motion to dismiss a lawsuit against Republican Gov. Glenn Youngkin over an executive order rescinding the state’s school mask mandate.
Attorney General Jason Miyares wrote in a post on Twitter that he requested the Virginia Supreme Court to dismiss the lawsuit against Youngkin filed this week by a group of parents whose children attend Chesapeake City Public Schools accusing the new administration of violating a Virginia law that requires each school board to implement guidance from the Centers for Disease Control and Prevention “to the maximum extent practicable.”
“I’ve asked the Supreme Court of Virginia to dismiss the lawsuit against [Gov.] Youngkin and Executive Order two, which restores authority to parents to make the best decision for their children,” Miyares said in his tweet. “With our filing, we again affirm that parents matter.”

Youngkin signed the order Saturday, his first day in office, leaving it up to each child’s parents whether they are subject to wear a mask, which is meant to hinder the spread of COVID-19.
“Recent government orders requiring virtually every child in Virginia wear masks virtually every moment they are in school have proven ineffective and impractical,” the order reads.

The lawsuit also names other state and Chesapeake officials as defendants. A spokesperson for the district earlier this week told 8 News, an ABC affiliate, that the system will file “an appropriate response.”

Youngkin signed 10 other executive orders, including a ban on the teaching of critical race theory and the promise to investigate previous wrongdoings in Loudoun County. His order on reversing the school mask mandate is poised to go into effect on Jan. 24.
Several Northern Virginia districts, including Fairfax, Arlington, and Prince William, announced that their mask guidelines will stay in place despite Youngkin’s order.
