A plastic hanger might not be worth much — unless you slip on it. Anne Volpe last week filed a $550,000 lawsuit against T.J. Maxx of 9616 Reisterstown Road, Baltimore, Md., alleging that on Oct. 31, an errant hanger caused her to “suddenly and without warning” slip and fall.
“T.J. Maxx Inc. had a duty to keep the floor clean and free from debris or other hazards on the floor at their place of business, especially in an area where customers would be walking,” Volpe’s lawyer, Harvey Okun, wrote in her lawsuit.
Volpe was browsing through merchandise when she “fell to the ground with great force and violence,” the suit states.
“Volpe sustained severe, painful and permanent injuries to her body,” including two fractures to her arm, according to the suit.
The suit says Volpe has been forced to spend money for doctors, nurses, X-rays and medical treatments for her injuries, including two fractures in her arm.
Volpe also suffered a “severe shock to her nerves and nervous system” and endures “extreme physical pain and mental anguish” because of slipping on the hanger, the suit states.
Okun said his client’s suit is not frivolous.
“I don’t sue for this kind of money for nothing,” he said. “She had had serious injuries. These medical bills pile up. She has permanent loss of motion. She’s a registered nurse, and she can’t even pump blood pressure now.”
A manager at T.J. Maxx saidhe was not authorized to speak with the media.
