Supreme Court to hear Missouri religious liberty case in late spring

The Supreme Court on Friday scheduled oral arguments for April in a crucial religious liberty case concerning state funding.

Federal appeals court Judge Neil Gorsuch’s Supreme Court confirmation proceedings begin March 20, and he could be seated on the court before arguments begin.

The high court will hear arguments in Trinity Lutheran Church v. Pauley on April 19. The Supreme Court will determine whether Missouri violated the Constitution in its decision to bar a church from a state program that gives nonprofits funding to resurface their playgrounds. Missouri’s Constitution includes a provision that prevents public funds from directly or indirectly aiding any church, sect or religion. The Supreme Court’s decision in this case could have a widespread impact on the other three dozen states whose constitutions feature similar provisions.

If he is confirmed to the Supreme Court in time to hear the case, Gorsuch could cast the deciding vote if the court divides evenly along ideological lines.
