Former President Donald Trump asked why “the mob” is taking the Fifth Amendment at a 2016 rally, according to a resurfaced clip.
Trump asked why aides of his then-presidential opponent, Democrat Hillary Clinton, were pleading the Fifth in the investigation into Clinton’s use of a private email server. A video recording of Trump asking the question at the rally resurfaced on Wednesday after Trump announced that he “declined to answer” questions during his deposition before New York Attorney General Letitia James’s office, according to Newsweek.
“So there are five people taking the Fifth Amendment, like you see on the mob, right?” Trump said in the clip. “You see, the mob takes the Fifth. If you’re innocent, why are you taking the Fifth Amendment?”

Trump’s statement on Wednesday addressed his questioning from 2016, claiming that he now knows “the answer to that question” and that a person has no choice but to take the Fifth when “all the people in your orbit” become a target. The former president also mentioned the FBI’s raid on his Mar-a-Lago home on Monday and that it had “wiped out any uncertainty” for him to remain silent.
“I have absolutely no choice because the current Administration and many prosecutors in this Country have lost all moral and ethical bounds of decency,” Trump’s statement read.

James has battled with Trump and two of his children, Ivanka Trump and Donald Trump Jr., for months in court to enforce a subpoena demanding testimony from the three of them. A New York judge rejected the trio’s appeals in June and demanded their compliance.
Trump’s two oldest children have reportedly already delivered testimony for the attorney general’s inquiry. Neither of them invoked Fifth Amendment rights against self-incrimination during their depositions, CNN reported.
