Cuccinelli health care petition on SCOTUS calendar

The U.S. Supreme Court has put a petition from Virginia Attorney General Ken Cuccinelli to directly hear Virginia’s health care case on its calendar for April 15, though a timetable for a ruling or decision has not been set.

Cuccinelli has argued that the uncertainty behind the law necessitates an expedited review from the country’s highest court, while Justice Department lawyers say that the case should proceed through the normal appellate process.

The case is scheduled for a May hearing in the 4th U.S. Circuit Court of Appeals.

In Cuccinelli’s case against the federal health care law, U.S. District Judge Henry Hudson ruled in December that the so-called “individual mandate” that will eventually require most people to purchase health insurance is unconstitutional. The Justice Department appealed the ruling.

The Supreme Court’s listing of Cuccinelli’s petition was first reported Thursday by the Richmond Times-Dispatch.
