BINGHAMTON, N.Y. (AP) — A high-ranking New York state senator is getting a primary challenge Tuesday.

The state Board of Elections on Friday officially lists a Republican primary challenge to Binghamton-area Sen. Thomas Libous from Denver Jones.

The Binghamton Press & Sun-Bulletin reports (http://press.sn/1xklWJb ) that the board and a state judge initially invalidated Jones’ petition for not having enough valid signatures. But an appeals court overturned that decision.

The litigation ended Wednesday when New York’s highest court, the state Court of Appeals, declined an application by the Broome County Republican Party to hear an appeal.

Libous is the Senate’s deputy majority leader. He pleaded not guilty this summer to a federal charge that he lied to the FBI about using his position to arrange a legal job and an inflated salary for his son.
