A judge dismissed the drunk driving case against the former head of the Federal Aviation Administration Thursday, according to the Fairfax City General District Court clerk’s office.
Randy Babbitt, 65, was charged with driving while intoxicated and driving the wrong way on a one-way highway in Fairfax City on Dec. 4. He was head of the FAA at the time of his arrest, and he resigned shortly after the incident.
Police had said that Babbitt was pulled over when a patrol officer saw him driving on the wrong side of the road on Old Lee Highway.
However, the Associated Press reported that Judge Ian O’Flaherty tossed the case after he saw a video of the left turn that caused the officer to pull Babbitt over, saying that the officer didn’t have a good reason to make the stop.
Although Babbitt’s lawyer said his client’s first breath test was under the legal limit, evidence about the test was not presented because O’Flaherty said it never should’ve been administered, the AP reported.
Babbitt was sworn in as the FAA administrator in 2009 and had flown for Eastern Airlines for 25 years.
