Former White House lawyer claims Cassidy Hutchinson did not write note to Trump on Jan. 6: Report

Two former Trump White House officials are claiming authorship of the same handwritten note that was presented as evidence in Tuesday’s Jan. 6 committee hearing, according to a report.

The note pertained to a statement intended for former President Donald Trump to release as his supporters stormed the Capitol on Jan. 6. A spokesperson for Eric Herschmann, a former White House attorney, told ABC News on Tuesday that the note was written by Herschmann on Jan. 6. During her testimony, Cassidy Hutchinson, an aide to White House chief of staff Mark Meadows, said she had written the note at the direction of Meadows.

“The handwritten note that Cassidy Hutchinson testified was written by her was in fact written by Eric Herschmann on January 6, 2021,” Herschmann’s spokesperson said.

“All sources with direct knowledge and law enforcement have and will confirm that it was written by Mr. Herschmann,” the spokesperson added.

Rep. Liz Cheney (R-WY) presented the note at Tuesday’s Jan. 6 committee hearing, which read, “Anyone who entered the Capitol without proper authority should leave immediately.”

Hutchinson testified that she wrote the memo after Meadows handed her a notecard and pen and told her to take his dictation.

“That’s a note that I wrote at the direction of the chief of staff on Jan. 6, likely around 3 o’clock,” Hutchinson claimed at the hearing.

“And it’s written on the chief of staff notecard, but that’s your handwriting, Ms. Hutchinson?” Cheney asked, to which Hutchinson replied, “That’s my handwriting.”

Hutchinson added that Herschmann suggested changing the language to “without legal authority.”

Herschmann had told the committee that he was the author of the note, according to the report.

A spokesperson for the Jan. 6 committee told ABC News that while Herschmann and Hutchinson “may have differing recollections of who wrote the note,” the important thing is that “both White House officials believed that the president should have immediately instructed his supporters to leave the Capitol building.”

The committee spokesperson added that it found Hutchinson’s account “credible.”

The Washington Examiner has reached out to Hutchinson’s lawyer for comment.
