Any Democrat or liberal group that indulged former President Joe Biden‘s attempt to amend the Constitution unilaterally should never again be listened to about threats to democracy or fighting authoritarianism.

Biden declared that the “Equal Rights Amendment” is now the 28th Amendment to the Constitution and is “the law of the land.” The ERA was a proposed amendment that failed to reach ratification by Congress’s self-imposed deadline of 1979 (and the Congressionally-extended deadline of 1982). The U.S. archivist correctly concluded that the amendment is dead as it currently stands, as did Biden’s own Justice Department in 2022.
