Larry Nassar denied final sentencing appeal in sexual assault case

Former sports doctor Larry Nassar was denied his final sentencing appeal Friday after he was convicted of sexually assaulting Olympic athletes.

The claims presented by Nassar’s attorneys that the judge who ruled against him was biased are not persuasive enough to warrant review, the Michigan Supreme Court ruled Friday. But the court did express some concern over the judge’s conduct in sentencing Nassar.

“We share the concerns of both the Court of Appeals majority and dissent about the conduct of the sentencing judge in this case and seriously question whether the majority committed error by affirming the trial court’s denial of defendant’s motion for disqualification and motion for resentencing,” the court decision said.

The Michigan Court of Appeals ruled against Nassar’s appeal in a 2-1 vote in December 2021, but all three judges expressed concern over the conduct of the sentencing judge, who in January 2018 used strong language when sentencing Nassar to 40 to 175 years in prison.

“I just signed your death warrant,” 30th Circuit Court Judge Rosemarie Aquilina said.

Aquilina also compared Nassar to a fictional villain while describing what would become of him to one accuser.

“The monster who took advantage of you is going to wither, much like the scene in The Wizard of Oz where the water gets poured on the witch and the witch withers away,” Aquilina said.

Nassar, who had been a sports doctor for USA Gymnastics and Michigan State University, was found guilty of sexually penetrating several young women in 2018. Gymnasts who came out to allege abuse included Olympic gold medalists Simone Biles and Aly Raisman.

Several of Nassar’s accusers, including Biles, announced earlier this month they would be seeking $1 billion from the FBI for failing to stop Nassar sooner.
