Biden must keep ‘Remain in Mexico’ immigration policy, Texas judge rules


A federal judge in Texas ruled Thursday that the Biden administration must keep former President Donald Trump’s “Remain in Mexico” policy in place.

President Joe Biden had attempted to halt the policy with a memo on October 2021, but U.S. District Judge Matthew Kacsmaryk said the policy must be reinstated while other legal challenges play out.

The policy calls for asylum-seekers to wait on the Mexican side of the southern border as their claims are either granted or denied and was implemented under the Trump administration. The Supreme Court previously allowed for the Trump-era policy to end by returning the litigation back to lower courts.

Texas Attorney General Ken Paxton, a Republican, celebrated the ruling, saying, “Biden’s open-border agenda won’t survive my legal attacks.”

The ruling comes as Title 42, a pandemic-era immigration policy that made it easier for officials to reject asylum claims, is set to expire later in the month, but border agents are in the dark on how to handle to the expected influx of immigrants.
