Ginsburg: Gay marriage rests on Ohio

Supreme Court Justice Ruth Bader Ginsburg suggested the fate of same-sex marriage bans could be decided in a courtroom in Ohio.

Speaking at the University of Minnesota Law School Tuesday, Ginsburg said the justices will be watching the Cincinnati-based 5th U.S. Circuit Court of Appeals, which is currently considering a gay marriage case.

Justice Ginsberg then said “there will be some urgency” if the appeals court allows same-sex marriage bans to stand, forcing the Supreme Court to step in, according to the Associated Press.

Without delving into specifics, Ginsburg admired the “remarkable” shift in the public perception of same-sex marriage, which is now legal in 19 states and the District of Columbia.

If the appeals panel falls in line with other rulings around the country, then there would be “no need for us to rush,” she said.

A provision of the federal Defense of Marriage Act, which denied a range of tax, health and veterans benefits to married gay couples, was struck down last year by the Supreme Court.
