President Obama’s executive amnesty has gone from being a political life raft for DREAMers to a legal nightmare for the White House.
According to The New York Times, Justice Department officials announced Wednesday they would not ask the Supreme Court to carry out the president’s executive amnesty.
This statement comes in the wake of two lost court battles.
First, in February when a federal court in Brownsville, TX put a hold on Obama’s executive amnesty and then again last week when the 5th Circuit Court of Appeals refused to overturn the lower court’s decision.
Legal experts now expect the court battle to extend for at least a year, making implementation very difficult as the administration will be in its final few months when the court reaches its verdict.
The Justice Department stated that the lower courts’ decisions undermine the program and make going to Supreme Court futile. Many illegal immigrants would be too scared to signup for a program that has a chance of being overturned.
