Conservative lawyer Larry Klayman, who represents Sheriff Joe Arpaio, laid down an ultimatum for the D.C. Circuit Court of Appeals Monday — stop President Obama’s immigration overhaul or “You’re not doing your job.”
Arpaio, who calls himself “America’s toughest Sheriff,” has been in a lawsuit with the president since November 2014. He is insisting Obama’s executive action that would allow up to 5 million illegal immigrants to evade deportation is overstepping his authority. And that the President’s Deferred Action of Childhood Arrivals (DACA) has been a magnet for more illegal immigration from Central America.
While many on the left insist that DACA has not caused an increase in unlawful migration, a recent memo from DHS confirms it was, in fact, a reason many new immigrants flocked across the border illegally.
Klayman argued before the court that the recent flock of more illegal immigrants has caused a $9 million financial strain on Arpaio’s jails.
While DACA has many eligibility requirements, such as prohibiting convicted felons and people with certain misdemeanors, most illegal immigrants aren’t aware of the specifications.
The Justice Department has been arguing that Arpaio lacks the standing to sue the administration.
Obama’s actions from November are on hold because of lawsuits brought by 26 states. In Feb. Judge Andrew Hanen sided with Texas that the federal government was placing a burden on the states due to Obama’s mandate.
