Rep. Maxine Waters, D-Calif., was taped earlier this month during an address at a benefit gala in New York City saying she would "take out" President Trump. Waters clearly wasn't suggesting she felt like killing the president, but plenty took it that way.

Many Republicans are still wondering why the nationalist firebrand wants to challenge GOP senators like John Barrasso of Wyoming or Roger Wicker of Mississippi, both of whom voted with the president more than 95 percent of the time -- more than Texas Sen. Ted Cruz (93.9 percent), who Steve Bannon has said he will not target. (Andrew Harrer/Bloomberg)

It might infuriate some of Sarah Palin's supporters, including President Trump, but this ruling in favor of the New York Times isn't surprising. As I predicted back in June, Palin was destined to lose for two simple reasons: Her case was very weak, and she could not reach the evidentiary standards required by U.S. civil law. U.S. defamation law is designed to preserve the right of individuals to speak out on matters of public concern. (AP Photo/Evan Vucci)
