A group of Republican legislators in Pennsylvania filed an amicus brief siding with Texas Attorney General Ken Paxton’s lawsuit before the Supreme Court alleging election fraud across a number of key battleground states.
State legislators accused the Pennsylvania Supreme Court of violating the Constitution by “offering extrajudicial guidance to the Commonwealth’s county boards of elections,” according to the brief filed Thursday evening.
“These efforts were condoned and furthered by the overreaching of Pennsylvania’s Supreme Court, in clear violation of the requirements of the U.S. Constitution,” read part of the brief.
Pennsylvania Majority Leader Jake Corman, who previously spoke against President Trump’s appeal for his support in overturning Pennsylvania’s presidential election results, filed a separate brief that neither supported nor rejected the state of Texas’s suit.
“This Court should affirm the grant of authority to state legislatures under the U.S. Constitution’s Elections Clause and disclaim state supreme courts and executive branch officials, from usurping that authority for themselves,” Corman wrote.
Paxton’s lawsuit centers on the states of Pennsylvania, Georgia, Wisconsin, and Michigan and contends that officials in each of the states tweaked voting rules to benefit the candidacy of President-elect Joe Biden.
