Appellate panel wants more to chew on before health care ruling

As if they didn’t already have enough to read.

A three-judge panel has directed Virginia, Liberty University and the federal governments to submit supplemental briefs — 10 pages max — by May 31 before it rules on the cases challenging President Obama’s health care overhaul as unconstitutional.

The 4th U.S. Circuit Court of Appeals panel heard oral arguments in the cases earlier this month.

In the case filed by Virginia Attorney General Ken Cuccinelli, the federal government is appealing a judge’s ruling that struck down the key provision in the law mandating that most Americans eventually purchase health insurance or face a penalty, while Liberty University is appealing a separate ruling that declared the law constitutional.

More than half of the states are trying to overturn the law. Most believe it will ultimately end up before the U.S. Supreme Court.
