Attorney General Douglas Gansler is withdrawing a subpoena demanding the computer hard drive and personnel records of a Green Party attorney, the Maryland branch of the American Civil Liberties Union said Tuesday.
Contending that the subpoena violates attorney-client privilege, the ACLU and the Maryland Green Party in late January asked the Maryland Court of Special Appeals to quash the subpoena. The state wanted the records to determine how much money it owed the Green Party after it won a lawsuit against the state.
“This a victory for every Marylander who cares about our court system?s respect for the rights of those who stand up to challenge civil rights violations,” said ACLU of Maryland Legal Director Deborah Jeon. “We view this turnabout by the state as a clear indication of Attorney General Gansler?s commitment to making Maryland a place where the government recognizes the necessity of vigorous enforcement of civil rights laws.”
