The former Trump attorney made misleading statements that overstated his role in Manhattan District Attorney Alvin Bragg’s case against Trump financial executive Allen Weisselberg and the Trump Organization, according to prosecutors. These misleading statements may have contributed to Bragg’s decision to back off his attempt to prosecute former President Donald Trump himself.

“Based on the motions, it seems unlikely that the DA would ever use Cohen as a witness against,” Daniel Alonso, former deputy to ex-Manhattan District Attorney Cy Vance, told the New York Daily News on Sunday.
“But could he be a witness against Trump?” Alonso added. “To start with, he has enormous credibility issues, not only because he has lied in the past and been convicted of it, but also because he has a strong motive to see Trump’s downfall.”
Cohen previously claimed he played a significant role in the district attorney’s case against Trump and Weisselberg.
“Despite providing over 400 hours of testimony that led to 18 different investigations, including [Trump’s] tax returns, including indictments of Weisselberg and others, they basically rode me door to door,” Cohen told the New York Daily News in November 2021.
Cohen’s statement has become particularly important in Weisselberg’s legal team’s attempts to dismiss the case. Cohen is a “vengeful” witness and “a veritable orchard of tainted fruit” whose presence has significantly affected the viability of Bragg’s case, according to the Trump Organization executive’s legal team.
However, Cohen’s words may not be accurate. Cohen “is not on the prosecution team, never testified in the grand jury, and has no basis to opine on what testimony” led to a June 2021 indictment of Weisselberg, according to a May 24 court filing.

Cohen was unconvinced by the challenge to his words and emphasized that he had “every right” to believe his multiple meetings with the district attorney’s office led directly to the June 2021 charges.
While Bragg has slowed his efforts since taking over for Vance in 2022, he has not stopped attempting to prosecute the Trump Organization. Weisselberg and the Trump Organization are set to go to trial this summer. Both parties have pleaded not guilty to dodging $1.7 million in taxes over 15 years.
