Tiger Woods and his girlfriend Erica Herman are being sued after staff at their restaurant The Woods allegedly over-served one of its bartenders, who was killed in December as he was driving home from one of his shifts.
The lawsuit, filed by the parents of Nicholas Immesberger, accuses Woods and Herman of wrongful death and claims they knew the 24-year-old struggled with alcohol abuse.
“The employees and management at The Woods had direct knowledge that Immesberger had a habitual problem with alcohol,” the lawsuit says.
“In fact, employees and managers knew that Immesberger had attended Alcoholic Anonymous meetings prior to the night of his crash and was attempting to treat his disease,” the lawsuit reads. “Despite this, the employees and management at The Woods continued to serve Immesberger alcohol while he was working as well as after work, while he sat at the bar.”
Woods and Herman also drank with Immesberger “only a few nights before the fatal crash of December 10,” according to the lawsuit.
Immesberger allegedly wrapped up his shift at 3 p.m. but stayed to continue drinking. His car crashed approximately 20 miles from The Woods at approximately 6 p.m. A civil complaint claims his blood alcohol level was three times above the legal limit.
Immesberger’s parents, Mary Katherine Belowsky and Scott Duchene, are seeking more than $15,000 in damages.
