A Baltimore County Circuit Court judge arrested earlier this week for drunken driving was told earlier not to sleep in his office in the courthouse.
Baltimore County Circuit Administrative Judge John Grayson Turnbull gave the order to Judge Lawrence Daniels before Daniels was pulled over by the Harford County Sheriff?s Department at 1:30 a.m. Sunday.
Turnbull said Tuesday that Daniels would continue in his job.
“He is a family law judge and he will remain a family law judge,” Turnbull said.
Courthouse insiders also said Daniels has recently been going through marital and personal difficulties.
Daniels failed a field sobriety test and was taken to Harford County?s southern police station, where he tested .09 on a breathalyzer, Presberry said.
Under Maryland law, a driver can be charged with DUI if the blood alcohol level is .08 or higher.
Daniels was given three citations of driving under the influence and released without incident, the sheriff?s department said.
“Judges are people like everybody else. They?re human beings,” said Andrew Alperstein, an attorney who has practiced in front of Daniels for years. “He?s very well-respected. He?s very fair. He really thinks about what?s the best resolution for a case before he makes a decision.”
Maryland judiciary officials said Daniels could face a range of disciplinary actions if convicted of a crime.
Daniels did not return phone calls seeking comment.
A lieutenant colonel in the U.S. Army, Daniels served as a Baltimore County District Court judge from 1989 to 1993, before becoming a Circuit Court judge.
If convicted, he could face up to two years in jail and a $2,500 fine.
