VA school board asks Supreme Court to postpone arguments in Gavin Grimm bathroom case

The Gloucester County school board in Virginia is asking the Supreme Court to postpone arguments in the Gavin Grimm case, a 17-year-old transgender boy suing to use the boys’ bathroom at his school.

Oral arguments are set to begin March 28, and the lawyers representing the local school board are asking the be postponed until at least April.

In a letter, Gloucester County school board says the justices should wait to get official input from the Trump administration before hearing Grimm’s case.

A delay could also allow for President Trump’s nominee Judge Neil Gorsuch — a conservative — to be confirmed.

The school board insists preventing Grimm — who was born female but identifies as a male — from using the boy’s bathroom is because Title IX protections only exist to “erase discrimination against women in classrooms, faculties and athletics” and do not apply to gender identity.

Last week, the Justice and Education Department removed Obama-era guidelines that allowed public school students to use the restroom facility corresponding to their gender identity. Despite the change, Grimm says his battle will continue.
