Former Virginia Attorney General Ken Cuccinelli said President Trump must “rewrite” the highly-contested travel ban order for it to survive court review.
Cuccinelli told CNN’s “State of the Union” on Sunday that a separate order for each category of the ban would be needed in order for it to survive.
That would imply Trump having to write individual orders for each of the seven Muslim-majority countries listed in the ban, including, Libya, Iraq, Iran, Syria, Sudan, Somalia and Yemen.
The 9th Circuit Court of Appeals halted the Trump order last week, prompting Cuccinelli to propose ways for Trump to allow the order to remain in place.
“Every single classification identified in the court process so far, I would write a new and separate order for,” he said Friday on Talk Radio 1210 WPHT.
Trump also said last week that he was considering writing a new order to supersede the original executive action.
