Harvey Weinstein loses appeal of rape conviction in New York case

The unanimous decision Thursday by a New York appellate court shot down Weinstein’s argument that he was the victim of misguided rulings by the trial judge, including one that allowed jurors to hear about allegations of misconduct for which he was not charged. Weinstein has denied all wrongdoing related to his charges.

“We perceive no basis for reducing the sentence, and we have considered defendant’s remaining arguments and find them unavailing,” the appellate judges wrote.

Juda Engelmayer, a spokesman for Weinstein, said they were “disappointed, but not surprised” and noted they would be “reviewing all of our options and will seek to petition the court appeals and beyond,” according to CNN.

Manhattan District Attorney Alvin Bragg, who took office in January, said in a statement that prosecutors were “gratified by today’s decision, which upholds a monumental conviction that changed the way prosecutors and courts approach complex prosecutions of sexual predators.”

Weinstein, 70, was sentenced to 23 years in prison in March 2020 after a Manhattan jury convicted him following allegations that he forcibly performed oral sex on former Project Runway production assistant Miriam “Mimi” Haleyi in 2006 and raped hairstylist Jessica Mann in 2013. He was acquitted of first-degree rape and two counts of predatory sexual assault in connection to actress Annabella Sciorra’s allegations of rape in the mid-1990s.

Weinstein appealed in April 2021, when his lawyers filed a 166-page brief detailing “several serious mistakes,” and argued he had been denied his right to be tried by an impartial jury.

He was extradited to California and jailed as he awaits trial following an indictment on 11 counts of rape, sexual battery, and other charges that are related to separate incidents involving five women between 2004 and 2013. Weinstein has pleaded not guilty in that case.

He could face up to 140 years in prison if convicted in the Golden State. His next court hearing is scheduled for July 29.
