The case of slain D.C. lawyer Robert Wone is returning to court Wednesday, with a Superior Court judge slated to hear arguments about the Fifth Amendment, a gag order and the statute of limitations in the wrongful death suit filed by Wone’s widow.
Katherine Wone has sued Joseph Price, Dylan Ward and Victor Zaborsky over her husband’s August 2006 death in their Dupont Circle townhouse. The trio was acquitted of covering up Wone’s slaying in a criminal trial this summer.
Among the issues attorneys are expected to debate at Wednesday’s status hearing in the civil case:
- The gag order defense attorneys want to bar parties in the case from speaking publicly about it (Katherine Wone’s lawyers, as well as some media outlets, have opposed the order)
- Whether Ward (and presumably the other defendants) must personally invoke the Fifth Amendment to avoid answer a question during a deposition, or whether his attorney can do so for him
- Whether the statute of limitations had passed when Katherine Wone filed suit
