DOJ sues three more states over state tuition benefits for illegal immigrants

Published August 10, 2026 3:50pm ET

The Justice Department on Monday sued New York, Connecticut, and Vermont, alleging that the states unlawfully provide in-state tuition rates and other financial benefits to illegal immigrants.

The lawsuits seek to block enforcement of state laws, regulations, and policies that allow immigrants who are not lawfully present in the United States to receive in-state tuition rates at public colleges and universities based on their state residency. The complaints also challenge policies providing financial aid and scholarships to illegal immigrants.
