11th Circuit Obamacare case — three-judge panel, two Clinton appointees

The three judge panel that will hear the Obamacare case in the 11th Circuit next month has been announced. Once again, the luck of the draw is not kind to conservatives:

Stanley Marcus — Clinton 
Joel F. Dubina — George H. W. Bush
Frank M. Hull — Clinton

So the odds may not look so good in the appeals case. However, Marcus was appointed to the district court by President Reagan before being bumped up by Clinton.

What’s more, a quick loss may be the best thing that can happen to the Obamacare challenge, since it’s bound to end up before the Supreme Court anyway.
