Ted Cruz: Justice Roberts wore ‘Obama jersey’ for Obamacare decision

Texas Sen. Ted Cruz took shots Monday night at Supreme Court Justice John Roberts, who he said “put on an Obama jersey” to play on the president’s team when deciding to uphold Obamacare subsidies last week.

“Well, he stopped serving as an umpire, and he instead suited up and became a player on one of the teams. And he put on an Obama jersey,” Cruz said on the Hugh Hewitt show. “And that is disappointing for an individual and a judge I respect so much to see him acting contrary to his judicial role.”

On MSNBC Tuesday morning, Cruz doubled down on his comments, saying Roberts “violated his oath.”

“He changed the law. He’s a good enough lawyer he knows he did that. It was deeply disappointing,” Cruz said on “Morning Joe.”

However, Cruz did tell Hewitt that Roberts’ dissent in the court’s 5-4 decision to allow same-sex marriage nationwide was “spot on.”

“He’s exactly right – that what the court did is it put its own policy judgments ahead of the policy judgments of the elected legislatures,” the 2016 Republican presidential hopeful said.

Cruz launched his 2016 campaign for the Republican presidential nomination in March. With 5.8 percent, he is currently eighth in a RealClearPolitics average of polls.
