Sen. Ted Cruz isn’t backing down from the fight against the Affordable Care Act, releasing a legal brief slamming the Obama administration’s “lawless implementation of Obamacare.”

In the report released Monday, Cruz examines the “abusive view of federal power” in the administration’s implementation of the Affordable Care Act. The second brief in Cruz’s “Legal Limit” series, the Tea Party darling focuses on the White House’s propensity to ‘undermine the rule of law’ and the pending litigation challenging Obamacare.
“President Obama has made explicit that if the Congress won’t agree to his preferred policies, then the President will simply rewrite the law through an abuse of executive power,” Cruz said, according to a press release. “For over two centuries, we have been a nation of laws, not men, and Republicans and Democrats should both be united against any President who refuses to follow the law. This arrogation of power to the Executive undermines the rule of law, and poses a grave threat to our Constitution and to the liberty of every American.”
The Texas conservative notes the media’s continued reports of the constitutionality of Obamacare following the landmark U.S. Supreme Court decision in 2012. Cruz, however, notes that several cases are still pending as a challenge to the law’s contraception mandate.
“Congress should repeal Obamacare in its entirety,” Cruz writes. “Until it is able to do so, however, courts should vindicate various pending lawsuits challenging Obamacare under provisions such as the Constitution’s Origination Clause, the Free Exercise Clause, the Religious Freedom Restoration Act, and the text of Obamacare itself. And more court challenges should be filed to stop the Obama administration’s lawless implementation of Obamacare.”
Cruz’s report goes on to highlight several instances of the Obama administration “lawless” implementation of the law, including the President’s one-year delay on all health insurance requirements following reports of millions of Americans receiving cancellation notices from insurance companies. Others include the one-year delay of the employer mandate and the administration allowing congressional staff to receive government-subsidized healthcare.
“There is no clearer example of the Obama Administration’s abusive view of federal power than its implementation of Obamacare,” the report states. “Repeatedly, the Administration has ignored the plain text of Obamacare, its ‘signature legislative achievement.’ Democrats forced a government shut down instead of agreeing to a congressional delay of Obamacare, but now the Obama administration is unilaterally delaying it. This undermines the rule of law.”
